As climate change continues to be a pressing issue affecting businesses, firms are taking proactive measures by integrating carbon considerations into their overall strategic planning for environmental sustainability. Nonetheless, the question of whether it pays to be green remains inconclusively answered. Based on an analysis of the 200 largest public listed firms by market capitalisation in Malaysia, the findings indicated that most of the firms are still reactive in managing their carbon activities; however, corporate carbon strategy does, indeed, lead to (...) better financial performance. The findings reaffirmed that going green pays off, particularly for firms with higher levels of foreign ownership. Interestingly, an inverse relationship was observed among firms with higher levels of government shareholdings. Additionally, the firms have been categorised into six different groups based on their scope and level of corporate carbon strategies, ranging from “wait-and-see” to “all-round explorer” classifications. Taken together, these findings enrich corporate carbon and sustainability literature and offer insights into theoretical and policy implications, along with suggestions for future research. (shrink)

Technological innovations, despite their several benefits, may have drawbacks, thus, they need a control mechanism or directional channel. Responsible innovation (RI) has gained popularity in technology-intensive countries as a way to regulate otherwise uncontrollable and radical technological innovations. However, existing RI research lacks a clear theoretical foundation and has not adequately addressed the commercial and performance aspects of innovative products and firms. The current research proposes an empirically testable model for RI by conducting a structured literature review, focusing on the (...) commercial aspect of innovative products and firms’ sustainability performance in the financial, social, and environmental dimensions. The study suggests a link between RI and the resource-based theory of the firm and proposes that RI can be seen as a distinctive competency developed through the firm’s resources and capabilities. The model would help enterprises achieve ethical and social acceptability and improve sustainability performance. Metadata examination of 98 articles yielded insights. The findings and future research directions of this study provide new insights for business strategy and policy. (shrink)

While many people today might turn to ancient Sanskrit philosophers for meditation or yoga, probably few would turn to them for help with difficult contemporary problems, such as what counts as "fake news" or navigating Internet debates. Philosopher Malcolm Keating argues that, in fact, a group of premodern Indian philosophers known as "Nyāya" have important things to say about how we can distinguish truth from falsity and reason well together, both of which are crucial to living a good life. -/- (...) KeatingA historically conversant reader interested in the current state of discourse regarding Catholicism and American politics will find a good amount of familiar discord. He will discover, for example, that the life issues continue to bedevil. Can a Catholic vote in good conscience for an abortion-rights candidate over a pro-life competitor if that candidate is more supportive of other (...) policies in line with Catholic Social Teaching? This issue has, of course, been with the American Church for some time now, even if it has taken on renewed urgency given the coincidence of the overturning of Roe v. Wade with the presidency of Joseph Biden, the second Roman Catholic to hold that office and a recent convert to pro-choice stridency. The action of the Supreme Court and the battles within the various states will ensure that abortion remains at the political heart of American Catholicism for years to come. One can say something similar about other issues, such as immigration, gun control, and economic justice. None of this will be found to be particularly surprising. The same cannot be said, however, of the return of a more fundamental question, one thought to have been settled since the mid-1960s. That question is whether Roman Catholicism and American liberal democracy are incompatible to the extent that Catholics ought to seek, if possible, another constitutional arrangement, one more friendly to the Catholic cause.Our reader would be familiar with the standard narrative that, while the existence of a medieval Church in a modern polity that upholds religious freedom had been a matter of concern since the dawn of the Republic, it [End Page 991] became serious only in the first half of the twentieth century as the number of Catholics and their influence grew. Until that time, American bishops, such as Archbishop John Ireland (1815–1918), made a special point of speaking publicly on the benefits of American freedom for the Church, just as they made clear that Catholics could be as patriotic as any other citizen. If there were tensions, they came primarily from anti-Catholic bigotry and governmental overreach. Things changed, however, when the point at issue was no longer primarily a religious one of Catholic believers infecting their Protestant neighbors with erroneous doctrine, but rather the threat so many Catholics posed to the fate of American freedom itself. In a postwar America concerned with the spread of Soviet communism, Paul Blanshard found a ready audience for his scholarly anti-Catholic diatribes, American Freedom and Catholic Power (1949) and Communism, Democracy, and Catholic Power (1951).1 Without much difficultly, he pointed to various statements of Gregory XVI and Pius IX condemning the separation of Church and state, the freedom of religious conscience, and democracy as the best governmental form. To top things off, he had Leo XIII's Testem Benevolentiae, an 1899 letter to the Cardinal Archbishop James Gibbons of Baltimore, warning him and his fellow bishops not to speak of the constitutional arrangement of the United States as a political ideal. While Leo had positive things to say about the American system, his admonition followed the traditional line: while constitutional protections of religious freedom are necessary when Catholics are in the minority, the ideal situation is a state that officially confesses and supports the Catholic religion. Of more recent vintage, Blanshard could quote the response of America's best-known Catholic theologian, Monsignor John A. Ryan, to the question of whether non-Catholics would be permitted to practice their religion in this ideal state:If these are carried on within the family, or in such inconspicuous manner as to be an occasion neither of scandal nor of perversion to the faithful, they may be properly tolerated by the State,... Quite distinct from the performance of false religious worship and preaching to the members of the erring sects, is the propagation of the false doctrine among Catholics. What is arguably the most important of the former disagreements is left until the final paragraphs, where he declares that he (now) rejects the principle of state neutrality and that we are comrades in believing that good perfectionist arguments for the promotion of meaningful work can be constructed (and may legitimately provide a basis for state action). The present essay grew out of an inte:rest in exploring the relationship be tween "imagination" and "reason" in the history of naturalistic thinking. The essay tries to show something of the spirit of naturalism coming to terms with the place of imagination and reason in knowing, making, and doing as activities of human experience. This spirit is discussed by taking as its point of departure the thinking of five writers: Plato, Aristotle, Giam battista Vieo, Jean-Jacques Rousseau, and John Keats. Plato (...) and Aristotle are considered as spokesmen of reason in a world which appeared to be dominated by non-reason. They found it essential for human beings to try to learn how to distinguish between the work of imagin ation and the work of reason. In trying to make such a distinction, it becomes clear that imagination has its legitimate place, along with reason, in human activity. Or we might say that determining the place which each has is a continuing problem when human beings take seriously what is involved in shaping mind and character. (shrink)

Against MacIntyre’s view that capitalism is incompatible with the conduct of economic production as a genuine practice, this paper claims that capitalist economies take a number of institutionally distinct forms, and that these differ significantly in the extent to which, and the reasons for which, they are antithetical to production as a practice. Drawing on the extensive literature in comparative political economy on varieties of capitalism, it argues that while ‘Liberal’ Market Economies such as the USA and UK conform quite (...) closely to MacIntyre’s understanding of capitalism, ‘Coordinated’ Market Economies such as Germany and Japan do not. Deconstruction is in love with denying this "nothing," but is seemingly unaware of how attempting demystification entangles the intellect all the more with the imagination. And it is the imagination that creates aesthetic experience, the very entity critics deny even exists. This dynamic is especially true of deconstruction looking at the Romantic mode of poetry: the poetry of poets who serve as their own subject. Analyzing the internalized quests of these poets, deconstruction offers a drama of itself too much in love with demystifying aesthetic experience, attempting and always failing, intellectually, to reduce it to nothing.Poets who write in the Romantic mode of poetry are in love with this "nothing"; they present internalized quests filled with their acute awareness of the aesthetic—and highly indeterminate—nature of being human. At the core of this indeterminacy is the ongoing debate between imagination and intellect, the first interested in exploring what is there, in human consciousness, the second prone to demystifying it. Poets who write in this mode learn that such improvable yet actual aesthetic experience or "nothing" is germane to being human. Keats's Endymion and Auden's "Caliban to the Audience" are frequently cited as prime examples of this demystification process. As I will argue, however, both of these poems deliberately dramatize the self-thwarting attempts of the intellect to dissect and dismiss what it claims is nothing.1Keats dramatizes this dynamic in Endymion, drawing attention to the way in which this "Brain-sick shepherd prince" claims—actually over-protests—to have loved "nothing" after his miraculous experience beneath the ocean with the strangely indeterminate creature, Glaucus (pp. 134, 206).2 Auden offers as well a detailed description of this dynamic in "Caliban to the Audience," the last section of The Sea and The Mirror, A Commentary on Shakespeare's The Tempest. In this poem, the strangely indeterminate, begged question of existence, Caliban, reveals in great detail his audience's futile attempt to demystify what upsets them.My argument concludes with a discussion of the way in which these poems dramatize deconstruction's unintentional witness to the "real Word" of the imagination (CP, p. 444).3As poets who write in the Romantic mode, exploring what is there in their consciousness, Keats and Auden find a great indeterminacy inherent in their human nature: an unresolved problem that they explore—rather than try to solve. The place of play in the education of young children has been the focus of much interest in the past. But the findings from this research project demonstrate that there remains a significant amount of confusion about the role that play has in young children's education. In particular we found that there is a clear distinction between the rhetoric and reality of play in the reception class. Further, there was evidence of real anguish for some early years workers who were (...) failing to offer the play activities that they knew should be provided. These findings are particularly interesting at present, since the debate on the role of play has once again emerged as fundamental in the attempt to define a curriculum appropriate to the needs of the 3-6 year olds who, from the year 2000, will be required to work within the highly contentious Foundation Stage of the National Curriculum. This article first briefly examines the textual structure of the Vangisathera Samyutta of the Pali Samyutta-nikaya in conjunction with two other versions preserved in Chinese translation in Taisho vol. 2, nos. 99 and 100. Then it compares the main teachings contained in the three versions. These three versions of this collection on the subject of the venerable Vangisa represent three different early Buddhist schools within the Sthavira branch. This comparative study of these three different versions focuses on three major topics: (...) Arhants at the pravarana ceremony; sensual desire and the way to extinguish it; and the Buddha’s teachings to Vangisa. It reveals similarities and significant differences in structure and doctrinal content, thus advancing the historical/critical study of early Buddhist doctrine in this area. (shrink)

This paper undertakes textual exegesis and rational reconstruction of Mukula Bhaṭṭa’s Abhidhā-vṛttta-mātṛkā, or “The Fundamentals of the Communicative Function.” The treatise was written to refute Ānandavardhana’s claim, made in the Dhvanyāloka, that there is a third “power” of words, vyañjanā (suggestion), beyond the two already accepted by traditional Indian philosophy: abhidhā (denotation) and lakṣaṇā(indication).1 I argue that the explanation of lakṣaṇā as presented in his text contains internal tensions, although it may still be a compelling response to Ānandavardhana.

In the Fragment on Evil, Hume announces that he “shall not employ any rhetoric in a philosophical argument, where reason alone ought to be hearkened to.” To employ the rhetorical strategy, in the context of the Fragment, just is to “enumerate all the evils, incident to human life, and display them, with eloquence, in their proper colours.” However, in Part 11 of the Dialogues Concerning Natural Religion, Hume employs precisely this rhetorical strategy. I discuss three interpretations that might account for (...) Hume’s decision to employ the strategy in the Dialogues but not the Fragment. The heart of this discussion concerns the relationship between reason and rhetoric. The Dialogues can be understood as part of the education of Pamphilus. Consequently, the three interpretations align with three ways of understanding the roles that reason and rhetoric play in Hume’s views on pedagogy and education (or more specifically, Philo’s attitude towards the education of Pamphilus). In this paper, I provide an account of subjective epistemic obligations. In instances of peer disagreement, one possesses at least two types of obligations: objective epistemic obligations and subjective epistemic obligations. While objective epistemic obligations, such as conciliationism and remaining steadfast, have been much discussed in the literature, subjective epistemic obligations have received little attention. I develop an account of subjective epistemic obligations in the context of worldview disagreements. In recent literature, the notion of worldview disagreement has been receiving increasing (...) attention, and I discuss how understanding worldview disagreements through different classes of beliefs might clarify our understanding of subjective epistemic obligations. I first distinguish between three classes of beliefs, by virtue of their justificatory functions within worldviews: fundamental, crucial and incidental. I then discuss four kinds of worldview disagreements based on this account. Finally, I argue that each disagreement results in different subjective epistemic obligations for each disputant. I conclude by discussing some implications this analysis has for issues such as defeat, peerhood, and epistemic injustice. (shrink)

It is widely accepted among Mencius scholars that for Mencius, the junzi 君子 is the kind of person who accepts Heaven’s will and never resents Heaven. There are, however, several passages where resentment seems to be presented as a quality that the junzi possesses. In particular, Mencius 2B13 has been the subject of much contention. In Section 1, I will discuss various interpretations of 2B13, building on and updating Philip Ivanhoe’s helpful 1988 survey. In Section 2, I will present an (...) argument for resentment against Heaven in the Mencius. I argue from passages in the Mencius and its relationship with the Shijing 詩經 that we have good reason to think that, under certain circumstances, the junzi ought to resent Heaven. In Section 3, I will develop a theory of resentment from the Mencius and demonstrate how 2B13 can be understood in the larger context of this theory. (shrink)

Dormandy argues that stubborn counterevidence provides a reason for Evidentialists to form negative beliefs about God. Focusing on ‘horrendous evils’ as a kind of stubborn counterevidence, I discuss two possible interpretations of Dormandy’s account (a stronger and a weaker view). Against the stronger view, I consider the case of a Committed Theistic Evidentialist, that is, an evidentialist who possesses a defeater belief against horrendous evils. I argue that it would be improbable that she would form negative beliefs about God on (...) the basis of horrendous evils alone. I consider the response of a Committed Theistic Evidentialist towards horrendous evils, arguing that for her, ‘honesty’, which results in a psychological struggle, is an excellent-making property of her faith. Abstract:Within various contexts, such as politics and parenting, Confucianism has been criticized on the basis that it endorses 'unquestioning obedience' to authority. In recent years, several philosophers have argued against this view by appealing to textual evidence from Classical Confucian philosophers. This article examines Wang Yangming's views on this subject, arguing that Wang teaches that criticism of those who stand in a socially superior role relation is not only permitted, but encouraged. From this, the implications that Wang's analysis has for (...) contemporary discussions of disagreement between epistemic superiors and inferiors and epistemic peerhood are considered. It will be argued that Wang's position is much closer to the total evidence view than the preemptive view. Relatedly, it is suggested that Wang provides a novel proposal about how to recognize or disregard epistemic 'superiors', especially in the context of moral knowledge. (shrink)

Hume begins his Dialogues Concerning Natural Religion by providing a discussion on what an ideal dialogue ought to look like. Many considerations that Hume raises coincide with similar concerns in contemporary social epistemology. This paper examines three aspects of Hume’s social epistemology: epistemic peerhood, inquiry norms and the possibility of rational persuasion. Interestingly, however, I will argue that the conversation between Philo, Cleanthes and Demea falls short of meeting Hume’s articulated standard of what an ideal dialogue ought to look like. (...) From this analysis, I defend the less popular view that Demea’s decision to leave the conversation (in Part XI) was entirely reasonable and suggest an explanation for why Hume decided to make Cleanthes the ‘hero’ of the Dialogues. Overtreatment refers to interventions that do not benefit the patient, or where the risk of harm from the intervention is likely to outweigh any benefit the patient will receive. It can account for up to 30% of health care costs, and is increasingly recognised as a widespread problem across nations and within clinical and scientific communities. There are a number of inter-related factors that drive overtreatment including the expanding definition of diseases, advertising and the influence of the pharmaceutical industry, how (...) doctors are trained and remunerated, demands from patients and the fear of complaints leading doctors to practise defensively.This paper discusses a number of ethical and practical issues arising from overtreatment that doctors and patients should be aware of. It also considers the flow-on effects of overtreatment such as the increased cost of care, increase in work load for health professionals, and wastage as resources are diverted from more genuine and pressing needs. In addition, there are references to a number of Medical Council of New Zealand statements about what good medical practice means in an environment of resource limitation. The paper concludes with a few measures that doctors and patients could take to reduce overtreatment but acknowledges that health care is extremely complex so it would be unrealistic to eliminate overtreatment entirely. While the existence of horrendous evils has generally been taken to be evidence against the existence of God, some philosophers have suggested that it may be evidence for the existence of God. This paper introduces three main kinds of theistic arguments from horrendous evils: the argument from objectively horrifying evils, the pragmatic argument from evil, and an argument from reasonable responses. For each of these arguments, I will first reconstruct a standard version of the argument, before suggesting ways the argument (...) may be challenged, or further developed. (shrink)

Moral anti-theodicists have posed a consequentialist argument against the theodical enterprise: that theodicies lead to harmful consequences in reality and that this should be sufficient reason to motivate abandoning the practise of theodicising altogether. In this paper, I examine variants of this argument and discuss several prominent responses from theodicists, including the separation thesis. I argue that while these responses are effective in resisting the global conclusion by the anti-theodicist, it still leaves the theodical enterprise vulnerable to a weaker version (...) of the consequentialist critique. In response, I develop an account of ‘theodicies-of-embrace-protest’ which is able to preserve the meaningful strides made in traditional theodicies while taking seriously the criticisms of the moral anti-theodicists. The reactive attitude of ‘resentment’ has been gaining increasing attention within contemporary philosophical literature. However, little attention has been given to the conceptions of resentment in Asian philosophy. In recent years, some philosophers have argued that there is a positive account of resentment in Confucian philosophy. This paper brings a recent Mencian account of resentment in conversation with contemporary philosophical discussions. The conversations revolve around aspects of resentment such as exculpatory conditions, payback, transition, and moral cultivation. Yet, it seems a valuable endeavour to understand the Fragment in its entirety—to understand its aims, central theses, core arguments, how each section relates to another, and so on. That is the aim of this paper. This country report provides an update on the status of Pre-University Philosophy education in Singapore.

The concept of self-efficacy has been widely studied and shown to contribute to individuals’ job satisfaction. For counselors, the concept measures their belief in their ability to conduct counseling sessions. However, it is an understudied area. As Bandura states, self-efficacy and its sources should be investigated and measured within its domain, which in this case is school counseling. This study examined the impact on school counselors’ self-efficacy and job satisfaction of the personal and environmental factors: mastery experience, social persuasion, vicarious (...) learning, physiological and affective state, the access to training, and perceived supervisor support of training. The cross-sectional study involved 541 Malaysian secondary school counselors nationwide via a random sampling-distributed questionnaire. Results which were analyzed using PLS-SEM, with importance-performance functionality embedded in it, indicated that mastery experience, access to training, and perceived supervisor support of training explained 45.6% variance in counseling self-efficacy and together with counseling self-efficacy, contributed 13.2% variance in job satisfaction among the school counselors. The importance-performance map analysis revealed supervisor support of training as of greatest importance in shaping counseling self-efficacy. Counseling self-efficacy partially mediated the relationship between mastery experience, access to training, supervisor support toward training, and job satisfaction Arising from this finding is a proposed theoretical framework in which efficacy information, environmental determinants and cognitive determinant corresponded together congruently and lead to higher job satisfaction. Suggestions are also made for training providers, content developers, and policymakers to include these factors in professional development training and continuous education, to sustain the wellbeing of school counselors. The word _meṇḍaka_, a derivative of _meṇḍa_ (“ram”), is generally translated as “made of the ram” or “about the ram” or “horned.” However, in the Pāli _Milindapañha_ (_Questions of Milinda_), the word _meṇḍakapañha_, literally, a question about the ram, is also rendered as a logical conclusion that refutes an imaginary dilemma. Hence, in this treatise, the word _meṇḍaka_ is a special logical term which means an imaginary dilemma that can be logically refuted. This raises the question as to why the (...) word _meṇḍaka_ has come to be associated with this logical technique. To answer this question, this paper examines various aspects of the word and its possible connections to a dilemma and its refutation. The discussion ranges from the meaning of this word in a tale in the _Jātaka_ (Birth Stories), within the contextual usage in a _meṇḍaka_ question, to a relatively recent commentarial text (_aṭṭhakathā_) which gives a different perspective on the etymology of the word. The _Milindapañha_ is explicit in defining a _meṇḍaka_ question as knotty, hard to penetrate, and difficult to resolve, some of which an opponent puts forth to undermine certain aspects of the Buddhist system. However, the way certain _meṇḍaka_ questions are framed, though not directly stated, seem to utilize the principles of logic in a dilemmatic form of argument. With that, a _meṇḍaka_ question, at least in the _Milindapañha_, could also mean “a dilemmatic expression put forth by a challenger to undermine an opponent, but which can be logically refuted.”. This article re-examines speculations about school affiliation of the Milindapañha (Questions of King Milinda) and traces its presence from North West India in the early centuries CE up to Southeast Asia in the nineteenth century. As there are significant differences between the textual traditions of the Pali Text Society’s Milindapañho and the Siamese printed edition, the Milindapañh?, I will discuss the little-known textual characteristics of the Siamese recensions which were circulating in Central Siam from at least the seventeenth century. This (...) is possible with the discovery of several Ayutthaya period Milindapañha manuscripts kept at a temple and the National Library of Thailand. By the end of the eighteenth century, at least three different recensions were circulating in Central Siam. This paper will present some of their dissimilarities as well as their probable textual lineages. The newly discovered manuscripts also partly demonstrate that the shape of the textual tradition of a text, at least for the Milindapañha in Siam, reflects a function of the textual community that preserved and transmitted it. How does a social enterprise pursue its ethical mandate of social impact growth while navigating the perils of the most vulnerable stage in a venture’s life—scaling up? We observe a small inclusivity social enterprise attempting to scale up rapidly to create equality for people with disabilities throughout the world. Our embedded, ethnographic study is terminated with the venture’s unfortunate demise after their dramatic effort to scale up failed. By examining scaling decision-making and conflicts around creation reasoning longitudinally, our study identifies (...) over-use of effectual logic—a creation reasoning type considered more ethical and more appropriate for high-innovativeness contexts than causal logic—as a major factor in the venture’s failure. From this insight, we extend the parameters of effectuation theory to scaling up and dimensionalize its ethical implications. Guidance for social entrepreneurs to scale up successfully while maintaining ethical integrity is also provided. (shrink)

Recital 33 GDPR has often been interpreted as referring to ‘broad consent’. This version of informed consent was intended to allow data subjects to provide their consent for certain areas of research, or parts of research projects, conditional to the research being in line with ‘recognised ethical standards’. In this article, we argue that broad consent is applicable in the emerging field of Computational Social Science (CSS), which lies at the intersection of data science and social science. However, the lack (...) of recognised ethical standards specific to CSS poses a practical barrier to the use of broad consent in this field and other fields that lack recognised ethical standards. Upon examining existing research ethics standards in social science and data science, we argue that they are insufficient for CSS. We further contend that the fragmentation of European Union (EU) law and research ethics sources makes it challenging to establish universally recognised ethical standards for scientific research. As a result, CSS researchers and other researchers in emerging fields that lack recognised ethical standards are left without sufficient guidance on the use of broad consent as provided for in the GDPR. We conclude that responsible EU bodies should provide additional guidance to facilitate the use of broad consent in CSS research. (shrink)

This paper builds on previous work that investigated anticancer drugs as ‘informed materials’, i.e., substances that undergo an informational enrichment that situates them in a dense relational web of qualifications and measurements generated by clinical experiments and clinical trials. The paper analyzes the recent transformation of anticancer drugs from ‘informed’ to ‘informing material’. Briefly put: in the post-genomic era, anti-cancer drugs have become instruments for the production of new biological, pathological, and therapeutic insights into the underlying etiology and evolution of (...) cancer. Genomic platforms characterize individual patients’ tumors based on their mutational landscapes. As part of this new approach, drugs targeting specific mutations transcend informational enrichment to become tools for informing their targets, while also problematizing the very notion of a ‘target’. In other words, they have become tools for the exploration of cancer pathways and mechanisms. While several studies in the philosophy and history of biomedicine have called attention to the heuristic relevance and experimental use of drugs, few have investigated concrete instances of this role of drugs in clinical research. Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. This article provides practitioners’ perspectives on preservation of the Irish web space by the National Library of Ireland. The context of this work is outlined including the history of Ireland’s national library, its role, resources and place in library, archive, cultural and digital preservation networks. The development of the NLI Web Archive is discussed within the wider context of the Library’s mission and digital collecting and preservation policies, as well as international approaches to preserving the web. The article looks at (...) how the NLI has developed its selective web archive over the past decade, and has grown the content and access to it as a way to mitigate against the absence of at-scale solutions. The unusual legal context in Ireland regarding legislative barriers to archiving the Irish web space at scale and the NLI’s work for over a decade to change this situation are discussed as are the significant implications of the current legal situation for data loss and long-term access to Ireland’s contemporary record. Distinctive Irish aspects of digital cultural heritage preserved in the NLI Web Archive collections are highlighted. The opportunities and challenges in developing outreach and access for the Web Archive are considered together with its relationship with the collecting activities of the Library’s Born Digital Pilot Projects. This article will also discuss types of usage and user groups in relation to archived Irish web data. Potential for creative and imaginative uses of Irish web archive collections and data are also considered in relation to the Library’s broader public learning and outreach programmes. (shrink)

There has been some concern m recent years that economic interests in the biotechnology area could, particularly through patenting, have a constricting influence on scientific research. Despite this concern, there have been no studies of this phenomenon beyond isolated cases. In this article we examine the evolution of the biomedical field of hybridoma/monoclonal antibody research with detailed examples of the three types of patent claims that have emerged there—basic claims, claims on application techniques, and claims on specific antibodies. We analyze (...) the impact of these claims and their legal histories on the free flow of scientific information and, the activity of scientific researchers. We conclude that such patent claims present severe restrictions for both, not only in the monoclonal area but in general, amounting to a subtle but significant shift in the political economy of science and technology.
